\n\tThe European Union leveled its first antitrust penalty against Apple on Tuesday, fining the U.S. tech giant nearly $2 billion for breaking the bloc\u2019s competition laws by\u00a0unfairly favoring its own music streaming service\u00a0over rivals.<\/p>\n

\n\tApple banned app developers from \u201cfully informing iOS users about alternative and cheaper music subscription services outside of the app,\u201d said the European Commission, the 27-nation bloc\u2019s executive arm and top antitrust enforcer. That is illegal under EU antitrust rules. Apple behaved this way for almost a decade, which meant many users paid \u201csignificantly higher prices for music streaming subscriptions,\u201d the commission said.<\/p>\n

\n\tThe 1.8 billion-euro fine follows a long-running investigation triggered by a\u00a0complaint from Swedish streaming service Spotify\u00a0five years ago.<\/p>\n

\n\t\u201cToday\u2019s decision marks an important moment in the fight for a more open internet for consumers,\u201d Spotify said in a statement following the decision. \u201cThe European Commission has made its conclusion clear: Apple\u2019s behaviour limiting communications to consumers is unlawful. This decision sends a powerful message \u2014 no company, not even a monopoly like Apple, can wield power abusively to control how other companies interact with their customers.\u201d<\/p>\n

\n\tThe EU has led global efforts to\u00a0crack down on Big Tech companies, including a series of multbillion-dollar\u00a0fines for Google\u00a0and\u00a0charging Meta\u00a0with distorting the online classified ad market. The commission also has opened a separate antitrust investigation into Apple\u2019s mobile payments service.<\/p>\n

\n\tThe commission\u2019s investigation initially centered on two concerns. One was the iPhone maker\u2019s practice of forcing app developers that are selling digital content to use its in-house payment system, which charges a 30% commission on all subscriptions.<\/p>\n

\n\tBut the EU later dropped that to focus on how Apple prevents app makers from telling their users about cheaper ways to pay for subscriptions that don\u2019t involve going through an app.<\/p>\n

\n\tThe investigation found that Apple banned streaming services from telling users about how much subscription offers cost outside of their apps, including links in their apps to pay for alternative subscriptions or even emailing users to tell them about different pricing options.<\/p>\n

\n\tOn Monday, Spotify said Apple\u2019s rules \u201cmuzzled\u201d the company and other streaming services from communicating with customers about such benefits. It noted that its own DSP, Apple Music was not barred from what it could tell users. \u201cBy requiring Apple to stop its illegal conduct in the EU, the EC is putting consumers first,\u201d the company said. \u201cIt is a basic concept of free markets\u2014customers should know what options they have, and customers, not Apple, should decide what to buy, and where, when and how.\u201d<\/p>\n

\n\tThe fine comes the same week that\u00a0new EU rules\u00a0are set to kick in that are aimed at preventing tech companies from dominating digital markets.<\/p>\n

\n\tThe Digital Markets Act, due to take effect Thursday, imposes a set of do\u2019s and don\u2019ts on \u201cgatekeeper\u201d companies including Apple, Meta, Google parent Alphabet, and TikTok parent ByteDance \u2014 under threat of hefty fines.<\/p>\n

\n\tThe DMA\u2019s provisions are designed to prevent tech giants from the sort of behavior that\u2019s at the heart of the Apple investigation. Apple has already revealed how it will comply, including\u00a0allowing iPhone users in Europe to use app stores\u00a0other than its own and enabling developers to offer alternative payment systems.<\/p>\n

\n\tThe commission also has opened a separate antitrust investigation into Apple\u2019s mobile payments service, and the company has promised to\u00a0open up its tap-and-go mobile payment system\u00a0to rivals in order to resolve it.<\/p>\n<\/div>\n<\/div>\n
