\n\tIce Spice<\/a> is facing a copyright lawsuit over allegations that her recent hit \u201cIn Ha Mood\u201d was copied from a Brooklyn rapper\u2019s earlier track.<\/p>\n \n\tIn a complaint filed Wednesday in Brooklyn federal court, the rapper D.Chamberz (Duval Chamberlain) says Ice Spice\u2019s 2023 song is \u201cstrikingly similar\u201d to his own \u201cIn That Mood\u201d<\/a> that he released in 2021.<\/p>\n \n\t\u201cBy every method of analysis, \u2018In Ha Mood\u2019 is a forgery,\u201d D.Chamberz\u2019s attorneys write in their complaint, obtained by Billboard<\/em>. \u201cAny proper comparative analysis of the beat, lyrics, hook, rhythmic structure, metrical placement, and narrative context will demonstrate that \u2018In Ha Mood\u2019 was copied.\u201d<\/p>\n \n\tIn addition to naming Ice Spice (Isis Naija Gaston) as a defendant, the lawsuit also names her frequent producer, RiotUSA (Ephrem Lopez, Jr.), as well as Universal Music Group, Capitol Records and 10K Projects.<\/p>\n \n\tReleased early last year following Ice Spice\u2019s 2022 breakout, \u201cIn Ha Mood\u201d reached No. 58 on the Hot 100 and No. 18 on the US Hot R&B\/Hip Hop Songs chart. It was later included on her debut EP Like..?<\/em>, and she performed the song during her October appearance as the musical guest on Saturday Night Live<\/em>.<\/p>\n \n\tBut D.Chamberz says the song shares so many similarities with \u201cIn That Mood\u201d that the overlap \u201ccannot be purely coincidental.\u201d He says the similar elements \u201cgo the core of each work,\u201d and are so obvious that they\u2019ve already been spotted by listeners.<\/p>\n \n\t\u201cNon-expert listeners have independently pointed out that Defendants \u2018stole\u2019 \u2018In That Mood\u2019 in creating In Ha Mood,\u201d the rapper\u2019s lawyers write. \u201cThe two songs clearly employ numerous noticeably similar composition elements and lyrics, which result in a sound and feel that are very much alike.\u201d<\/p>\n \n\tIn any copyright lawsuit, an accuser like D.Chamberz must show that an alleged infringer had \u201caccess\u201d to their work in order to copy it. That requirement might seem technical, but it\u2019s often the fatal flaw in copyright cases filed by lesser-known acts, like one filed against Dua Lipa over \u201cLevitating.\u201d<\/a><\/p>\n \n\tIn an effort to show \u201caccess,\u201d Tuesday\u2019s lawsuit notes that D.Chamberz shared \u201cIn That Mood\u201d to his Instagram followers, and that the song got \u201csignificant airplay\u201d on New York City radio stations, including Hot 97 and Power 105.1. It even cites one instance in which Riot allegedly posted an Instagram story of him listening to Hot 97 \u201cless than two minutes\u201d before the song was played on the air. And Chamberz\u2019s lawyers also point out that Riot\u2019s father is the well-known New York City radio personality DJ Enuff, who hosts a show on Hot 97 and allegedly \u201cactively engaged with D.Chamberz\u2019s social media content.\u201d<\/p>\n \n\t\u201cBased on all of the facts and circumstances known to plaintiffs, as described above, it is probable \u2013 or, at the very least, reasonably possible \u2013 that defendants heard the work and knew about the work prior to the creation and publication of \u2018In Ha Mood,\u2019\u201d his lawyers write.<\/p>\n \n\tRead the full lawsuit filed against Ice Spice here:<\/strong><\/p>\n
